Terms of Service
Quick summary. These terms govern your use of Don't Bail, including paid events. You must be 18 or older. For every paid event, the identified host—not Don't Bail—is the event seller and provider. Don't Bail supplies marketplace, payment, admission, and attendee-management tools. The host is responsible for delivering the event and for the venue, permits, safety, listing accuracy, and event-related disputes.
1. Agreement to Terms
These Terms of Service ("Terms") are a legal agreement between you and Lineup Labs (OPC) Private Limited ("we," "us," or "our"). By creating an account or using the Don't Bail mobile application, hosted checkout, website, or related services (together, "Don't Bail"), you agree to these Terms, our Privacy Policy, and our Refund and Cancellation Policy.
These Terms include important disclaimers, assumption-of-risk provisions, a release, limits on our liability, and your obligation to indemnify us. Read them carefully before using Don't Bail or attending any event coordinated through Don't Bail.
If you do not agree to these Terms, do not use Don't Bail.
2. Eligibility
You must be at least 18 years old to create an account and use Don't Bail. By using the app, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.
If we learn that a user is under 18, we will immediately terminate their account and delete all associated data.
3. Your Account
3.1 Account creation
You create an account by verifying your mobile phone number via a one-time password (OTP). You must provide accurate and complete information, including a valid mobile phone number.
3.2 Account security
You are responsible for maintaining access to the phone number associated with your account, all activity that occurs under your account, and notifying us immediately at developer@uselineup.app if you believe your account has been compromised.
3.3 One account per person
Each person may maintain only one active Don't Bail account. We reserve the right to merge or remove duplicate accounts.
4. Acceptable Use
You agree to use Don't Bail only for lawful purposes and in accordance with these Terms. You must not:
- Post illegal content -- upload, share, or transmit any content that violates applicable law.
- Create unsafe or illegal events -- create, promote, or coordinate events involving unlawful activity, dangerous conduct, violence, non-consensual activity, illegal substances, weapons, or any activity that creates an unreasonable risk of harm.
- Post false or misleading event information -- provide event titles, descriptions, times, locations, availability, RSVP information, scores, or other content that is false, deceptive, defamatory, harmful, or likely to mislead other users.
- Harass or abuse others -- engage in harassment, bullying, threats, hate speech, or any behavior intended to intimidate or harm other users.
- Impersonate others -- create a false identity or misrepresent your affiliation with any person or organization.
- Spam or mislead -- send unsolicited messages, create fake events, or use the app to deceive other users.
- Expose sensitive information -- post another person's personal, private, sensitive, confidential, medical, financial, identity, or safety information without a lawful basis and their permission.
- Interfere with the service -- attempt to disrupt, overload, or compromise the app's infrastructure, security, or functionality, including through automated scripts, bots, or scraping.
- Reverse engineer -- decompile, disassemble, or reverse engineer any part of the app or its backend systems.
- Circumvent restrictions -- bypass any security measures, rate limits, or access controls.
- Collect user data -- harvest or collect information about other users without their consent.
- Misuse paid events -- sell unlawful, misleading, unsafe, counterfeit, prohibited, or non-existent event access; manipulate purchases, chargebacks, admissions, payouts, or reviews; or use Don't Bail to launder money or conceal the true event provider.
We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these rules, including account suspension or termination and reporting to law enforcement.
5. Content Ownership
5.1 Your content
You retain ownership of all content you create or submit through Don't Bail, including event titles, event details, locations, availability polls, task text, scorecard text, chat messages, group names, display names, and any other information you provide ("Your Content").
By using Don't Bail, you grant us a limited, non-exclusive, worldwide license to use, store, and display Your Content solely for the purpose of operating and providing the Don't Bail service. This license ends when you delete Your Content or your account.
5.2 Your responsibility for Your Content
You are solely responsible for Your Content and for the consequences of posting, sharing, relying on, or acting on it. You represent and warrant that Your Content is accurate to the best of your knowledge, lawful, non-infringing, and that you have all rights and permissions needed to submit it.
We do not endorse, verify, guarantee, or assume responsibility for any user-created event, event title, free-text field, message, group name, display name, RSVP, score, note, location, poll, task, or other user content. Moderation, reporting, blocking, filtering, or removal tools do not create any duty for us to monitor, review, verify, prevent, or remove any content or conduct.
5.3 Our content
The Don't Bail app, including its design, code, features, and branding, is owned by Lineup Labs (OPC) Private Limited and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding.
6. Events, User Conduct, and Safety
6.1 Don't Bail is a coordination tool, not an event organizer
Don't Bail provides software that helps users coordinate private events, groups, RSVPs, chat, tasks, scorecards, live location, reminders, and related activity. Don't Bail does not create, organize, host, sponsor, supervise, control, or guarantee any event, venue, participant, route, transportation, equipment, activity, weather condition, medical condition, safety condition, or user conduct.
6.2 You assume all event and in-person risks
You are solely responsible for deciding whether to create, join, attend, leave, travel to, participate in, or continue participating in any event. You assume all risks connected with events and in-person interactions, including risk of personal injury, illness, death, property damage, theft, harassment, assault, unsafe conditions, transportation issues, inaccurate directions, venue issues, cancelled events, no-shows, and the conduct of other users or third parties.
6.3 No safety, emergency, or professional advice
Don't Bail is not a safety service, emergency service, transportation service, venue service, medical service, professional adviser, background-check service, or insurance provider. Do not rely on Don't Bail, notifications, RSVPs, live location, ETA, arrival status, punctuality, scorecards, ratings, chat, or any other app feature for emergencies, personal safety decisions, medical decisions, transportation decisions, or legally significant decisions. Contact local emergency services if you need urgent help.
6.4 Your event responsibilities
If you create, administer, invite people to, or attend an event, you are responsible for complying with law, selecting a lawful and reasonably safe location, communicating accurate event details, obtaining permissions and permits where required, respecting other users, and making your own safety, travel, equipment, health, and participation decisions.
6.5 Paid-event marketplace roles
For each paid event, the person identified as the host is the seller, organizer, and provider of the underlying event service. Don't Bail is a marketplace intermediary and limited payment-collection facilitator. Don't Bail is not the seller, organizer, promoter, venue operator, employer, partner, or agent of the host except for the limited authority to collect attendee payments, maintain transaction records, facilitate admission, and remit host proceeds under the Paid Event Host Agreement.
The host is responsible for the event's description, price, availability, venue, legality, licences, permits, taxes, safety, delivery, cancellation communications, and event-related consumer complaints. The checkout and payment confirmation identify the host and separately display the host's ticket proceeds, Don't Bail fee, and total guest payment.
6.6 Paid-event purchases and admission
A pending checkout is not admission. Admission is created only after Don't Bail verifies a captured payment or the host grants complimentary access. A short checkout hold may temporarily reserve one place while a payment is completed. If a late or conflicting payment cannot be fulfilled within capacity, Don't Bail may initiate a technical reversal. A paid entitlement remains attached to the purchasing account unless the payment is externally reversed or refunded; leaving or removal does not by itself create a refund or require a second payment to rejoin. A host may separately ban an account from rejoining without automatically reversing its payment.
Admission credentials and QR codes are personal, revocable security credentials. You must not sell, duplicate, publish, or share them. A successful scan records the event, credential, scanner, time, and outcome.
6.7 Prices, fees, and payment processing
Paid events currently use INR. The host chooses the whole-rupee ticket proceeds shown at checkout. Don't Bail's initial transaction fee is 5% of the total guest payment, calculated in integer paise using commercial half-up rounding. The checkout total is calculated so that the displayed host proceeds remain exact. Don't Bail currently absorbs ordinary payment-processing economics from its fee unless checkout expressly states otherwise.
Payments are processed by an identified third-party payment provider. Your bank, card issuer, UPI application, or payment provider may apply its own terms. Don't Bail does not store full card numbers, UPI credentials, banking passwords, or card security codes.
6.8 Refunds, cancellations, reversals, and disputes
Don't Bail does not offer discretionary refunds or independently decide event-quality disputes. Attendee change-of-mind requests and complaints about the underlying event must be addressed to the identified host. If a host cancels an event through Don't Bail, Don't Bail will initiate a full refund of the recorded guest payment. We may also process duplicate-charge corrections, capacity-race reversals, payment-provider reversals, chargebacks, fraud reversals, or refunds required by law. 6.9 Financial records
After a payment occurs, Don't Bail may retain the event, host identity, purchase, entitlement, payout, acceptance, cancellation, and audit records and may prevent hard deletion where needed for accounting, fraud prevention, disputes, legal compliance, or enforcement. This can continue after account deletion as described in our Privacy Policy.
7. Push Notifications
Don't Bail uses Firebase Cloud Messaging (provided by Google) to send push notifications about events, RSVPs, and group activity. You can enable or disable notifications at any time through your device's settings. Disabling notifications does not affect your account or access to other features.
8. Service Availability
We strive to keep Don't Bail available and reliable, but we do not guarantee uninterrupted or error-free service. The app is provided on an "as is" and "as available" basis.
We may temporarily suspend the service for maintenance, updates, or security reasons; modify, add, or remove features at any time; or discontinue the service entirely, with reasonable notice where possible. We are not liable for any loss or inconvenience caused by service interruptions, downtime, or changes to features.
9. Release
To the maximum extent permitted by applicable law, you release Lineup Labs (OPC) Private Limited, its officers, directors, employees, contractors, agents, service providers, successors, and assigns from all claims, demands, damages, losses, liabilities, costs, and expenses arising from or related to:
- Your Content or any other user content, including event titles, descriptions, locations, messages, polls, tasks, scorecards, group names, display names, RSVPs, ratings, reports, and any free-text fields.
- Any event created, discovered, coordinated, attended, cancelled, changed, or discussed through Don't Bail.
- Any in-person meeting, travel, venue, activity, equipment, weather condition, safety condition, health condition, third-party service, or transportation connected with an event.
- The acts, omissions, statements, content, or conduct of any user, event host, attendee, venue, transportation provider, service provider, or other third party.
- Your reliance on app information, notifications, availability, RSVP status, location, ETA, arrival status, punctuality, scorecards, skill ratings, chat, or other app features.
This release applies whether the claim is known or unknown, suspected or unsuspected, and whether arising before or after you accept these Terms, except to the extent a release is prohibited by law.
10. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law:
- No warranty. Don't Bail is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, availability, security, and non-infringement.
- No content or event warranty. We do not warrant or guarantee the accuracy, legality, quality, safety, suitability, availability, attendance, conduct, location, timing, completeness, or reliability of any event, user, venue, event title, event detail, free-text content, message, RSVP, availability poll, scorecard, rating, location, ETA, arrival status, notification, or other content or feature.
- No user or third-party liability. We are not liable for the acts, omissions, content, statements, promises, failures, negligence, misconduct, criminal activity, or other conduct of users, event hosts, attendees, venues, transportation providers, service providers, or other third parties.
- No in-person or event liability. We are not liable for injuries, death, illness, emotional distress, property damage, theft, lost opportunities, travel costs, venue problems, unsafe conditions, cancelled events, no-shows, disputes, harassment, assault, or any other harm connected with events or in-person interactions.
- No liability for damages. Lineup Labs (OPC) Private Limited, its officers, directors, employees, contractors, agents, service providers, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, reputation, opportunity, or expected savings arising from or related to your use of Don't Bail, your inability to use Don't Bail, events, user content, or third-party conduct.
- Liability cap. To the extent a cap is permitted by applicable law, our total aggregate liability to you for all claims arising from or related to these Terms or your use of Don't Bail shall not exceed the greater of (a) the fees you paid directly to Don't Bail in the 12 months before the claim arose, or (b) INR 5,000. This cap does not limit liability that cannot lawfully be excluded or limited.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Lineup Labs (OPC) Private Limited and its officers, directors, employees, contractors, agents, service providers, successors, and assigns from any claims, demands, damages, losses, liabilities, settlements, judgments, costs, or expenses (including reasonable legal fees) arising from or related to:
- Your use or misuse of Don't Bail.
- Your Content, including event titles, descriptions, messages, group names, display names, polls, tasks, scorecards, locations, or any free-text content.
- Any event you create, administer, invite people to, attend, cancel, change, or coordinate through Don't Bail.
- Your in-person conduct, travel, venue choice, equipment, safety decisions, or interactions with users or third parties.
- Your violation of these Terms, applicable law, or any right of another person or entity.
- Any allegation that your content or conduct caused injury, death, property damage, privacy harm, reputational harm, intellectual-property harm, or other loss to another person.
12. Termination
You can delete your account at any time through the app's account settings. We may suspend or terminate your account at any time if you violate these Terms, your account is used for illegal activity, we are required to do so by law, or we discontinue the service with reasonable notice where possible.
Upon termination, your right to use Don't Bail ceases immediately. Sections that by their nature should survive termination, including Content Ownership, Events and Safety, Release, Disclaimers and Limitation of Liability, Indemnification, Dispute Resolution, Governing Law, and General Provisions, will continue to apply.
13. Dispute Resolution
If you have a dispute with us, please contact us first at developer@uselineup.app. We will attempt to resolve the issue informally within 30 days.
If informal resolution fails, the dispute will be resolved in accordance with the governing law specified below. Nothing in this section limits your right to bring claims before a competent court in your jurisdiction where required by applicable law, including consumer protection laws in the EU, India, or Canada.
To the maximum extent permitted by applicable law, you and Don't Bail agree that claims must be brought only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated, private attorney general, or representative proceeding.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Mandatory consumer rights and remedies that cannot be waived remain available.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the app or through another reasonable notice at least 30 days before the changes take effect and update the "Last updated" date at the top of this page.
Your continued use of Don't Bail after the effective date of revised Terms constitutes acceptance of those changes. If you do not agree with the revised Terms, you should stop using Don't Bail and delete your account.
16. General Provisions
- Entire agreement. These Terms, together with our Privacy Policy and Refund and Cancellation Policy, constitute the agreement between attendees and us regarding Don't Bail. Paid-event hosts also accept the versioned Paid Event Host Agreement.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
- No waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.
- No third-party beneficiaries. These Terms do not create any third-party beneficiary rights.
- Force majeure. We are not responsible for delay or failure caused by events beyond our reasonable control, including internet outages, cloud-provider failures, device or app-store issues, labor disputes, government action, emergencies, natural disasters, war, terrorism, civil unrest, or acts of third parties.
